Swann & Neeley Obtain Summary Judgment in Construction Defect Case

Attorneys Gerald Swann and Graham Neeley recently received summary judgment in a construction defect case pending in the Circuit Court of Mobile County.


The project was a large apartment complex with several hundred units and the Plaintiff alleged that improperly installed pipe was resulting in leaks throughout the complex. The Complaint alleged the contractor failed to follow the plans and specifications during construction, asserting claims of breach of contract, negligence, wantonness, breach of warranty, fraud, concealment, and suppression.


In finding for the Defendant, the Court found the Plaintiff’s claims were barred by the Statute of Repose and/or the applicable Statute of Limitations.
