Attorneys Waller & Simpler Obtain Dismissal of Claims Against Premises Owner in Wrongful Death Case

Attorneys Chris Waller and Miland Simpler recently obtained a dismissal of all claims against a premises owner, in a wrongful death case that involved a minor drowning in their client’s pool.

The Court granted the relief sought in a 12(b)(6) motion based upon arguments and authorities asserting that the complaint failed to articulate any duty as a matter of law. The case was pending in the Circuit Court of Montgomery County.

Chris Waller is a partner in the Montgomery office and serves on the firm’s Executive Committee.
