October 2015 – Marks Obtains Dismissal of Suit in Federal Court

Emily Marks obtained a dismissal of a lawsuit against an administrator in the Middle District of Alabama. The plaintiff claimed violations of her first amendment rights to free speech and freedom of association. After extensive briefing, the district court granted the defendant’s Motion to Dismiss based on qualified immunity. Ms. Marks successfully argued that the doctrine of qualified immunity shielded her client from suit because the actions alleged by the plaintiff did not violate clearly established law.
