Attorney Ben Heinz Wins Appeal


In an update to the August 2015 directed verdict that Ben Heinz obtained on behalf of a liability insurer in a Mobile County hospital lien impairment case, the Court of Civil Appeals recently issued a “No Opinion” affirmance of the trial court’s decision. Appellant University of South Alabama had appealed the directed verdict based upon a variety of arguments aimed at showing the statute of limitations had not run on its lien impairment claim. Ben prepared the brief submitted on behalf the firm’s client. The Court of Civil Appeals’ decision, by rule, means that the Court determined that the record supported the directed verdict, that there were no errors of law or other clear errors by the trial court, or that the University did not present any arguments upon which an opinion would serve a precedential purpose.
