August 2006 - Firm Obtains Summary Judgment for Three Clients in a Premises Liability Case The Firm secured summary judgment for its clients in a premises liability case. In the case the firm represented three employees of the Mobile County School System against a plaintiff who was injured while walking in "complete darkness." The defendants argued that under Alabama law, "total darkness" is an open and obvious danger as a matter of law, thus there is no duty to warn. The case was defended by Jay Watkins of the firm’s Baldwin County office. |
