March 2005 - Appellate Court Affirms Trial Court's Decision in Favor of Insurer In a four-to-one decision, the Alabama Court of Civil Appeals held that the trial court properly enforced a settlement reached between the Defendant Insurer and the Plaintiff. The Plaintiff claimed that there was no valid enforceable settlement between the parties. Both the trial judge and the Court of Civil Appeals rejected the Plaintiff's argument, finding that there was sufficient evidence of a "meeting of the minds" between the parties. The settlement was therefore enforceable, as requested by the Defendant Insurer. The case was defended by Bill Brittain and Evans Brittain.
