April 2010 - Waller Obtains Summary Judgment for Firm's Client in Wrongful Death Action
In a Coosa County case, Chris Waller obtained a summary judgment in favor of his client, an insurance company, against claims brought by the plaintiff's decedent, arising out of a motor vehicle accident which resulted in plaintiff decedent's death. Waller successfully argued that any negligence claims brought by the plaintiff were due to be dismissed pursuant to Alabama's Guest Passenger Statute and that the defendant tortfeasor's actions did not constitute wanton conduct. The Circuit Court agreed and entered summary judgment accordingly.
