November 2009 - Swann Receives Defense Verdict in Vehicle Accident Case
Montgomery County Defense Verdict: A jury in Montgomery County on November 18th, deliberated for one hour before returning a defense verdict. The defendant was operating his motor vehicle on a service road adjacent to the Eastern Boulevard. The plaintiffs were stopped in their vehicle waiting for traffic to enter the Boulevard. The defendant, believing the plaintiffs were proceeding, realized they were in fact stopped and collided with the rear of the vehicle. There was no visible damage to either vehicle though later it was discovered brackets holding the rear bumper of the plaintiffs' Lincoln Town car had been broken in the collision. Medical treatment was refused at the scene, but three days later the three plaintiffs presented to a local emergency room where they were found to have soft tissue injuries. Six days later each of the plaintiffs began seeking the care of a chiropractor for their injuries and continued care for eight weeks before being released.
The plaintiffs claimed no permanent injuries or lost wages. Medical expenses totaled in excess of Twelve Thousand dollars. Blue Cross asserted a lien of Five Thousand Nine Hundred and Six dollars for expenses it had paid. The plaintiffs claimed out of pocket expenses of Two Hundred dollars.The jury finding for the defendant found the accident to not have been caused by any negligent conduct.
