May 2007- Summary Judgment Entered in Favor of the Defendant in UIM Case
Evans Brittain obtained a summary judgment in favor of the Defendant UIM carrier in Elmore County. The trial court held that the Plaintiff was not legally entitled to recover from the UIM carrier because the Plaintiff had previously settled with the tortfeasor, a governmental entity, for the maximum amount recoverable pursuant to the statutory cap concerning governmental entities.
