September 2008. The Alabama Supreme Court recently affirmed a July 2007 defense verdict obtained by Monty Montgomery and Jay Watkins in the Circuit Court of Mobile County, Alabama. The case centered around whether a driver's inoperable brain tumor caused or contributed to an accident that caused a young lady to undergo three surgical procedures on her knee. After obtaining Judgment as a Matter of Law on the wanton entrustment counts, the jury returned a defense verdict on all counts after less than 30 minutes of deliberations. The Plaintiff appealed a number of issues, all of which were rejected by the Alabama Supreme Court. The cite for the opinion is Jordan ex rel. Jordan v.
