March 2007 - Motion To Dismiss/Summary Judgment Granted

A home owner sued his general contractor alleging numerous defects in the construction. The general contractor by third party complaint sought indemnity against subcontractors, which included our client . Gerald C. Swann, Jr. on behalf of our client was able to successfully argue the third party complaint did not state a cause of action in that there was no contract of indemnity, the general contractor had overall job supervision, and that the complaint sought contribution among joint tortfeasor. Judge Martin entered the order granting our client's motion on March 23, 2007.
