July 2007 - Alabama Court of Civil Appeals Upholds Summary Judgment for Firm's Clients in Premises Liability Case. The Alabama Court of Civil Appeals recently upheld a summary judgment in favor of the firm's in a premises liability case. The Court then denied plaintiff's application for rehearing. The defendants argued that under Alabama law, "total darkness" is an open and obvious danger as a matter of law, thus there is no duty to warn. The case was defended by Jay Watkins of the firm's Baldwin County office. |
